Terms and Conditions

The provisions below outline the terms and conditions by which we operate and your use of this website constitutes your acceptance of them.

Cruising Down Under PTY LTD Booking Terms & Conditions

1. Booking Requests
All booking requests are subject to availability at the time and date of request receipt. Written
confirmation of the request and confirmation of the price will be provided in email format. Mailed or faxed confirmations will be sent only on request.

2. General Conditions
Cruising Down Under Pty Ltd act as agent only for the cruise lines, airlines, accommodation providers and tour and transportation companies providing services. We accept no liability caused directly or
indirectly by such, including, but not limited to: war, terrorism, civil disturbance, fire, floods, acts of God, and acts of Government or of any other authorities, accident to or failure of machinery or equipment or industrial action.
Additionally, we make no representation as to the safety or conditions that any destination offers.
Whilst acting in good faith we are subject to the terms and conditions and limitations of liability imposed by suppliers involved in your travel booking, some of which limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. We do not accept responsibility for injury, inconvenience, loss, damages, and delay to persons or property, or for related expenses on the part of employees, agents or individuals providing the services. Furthermore we do not accept responsibility for any loss, damage, delay, injury, and inconvenience or for any related expense for any omission, error or any misleading statement or information supplied by us or the operators of all services purchased.
The issuance and acceptance of any tickets, service vouchers or exchange orders is deemed as passenger consent to these conditions.
It may be necessary for airline/port/government agencies to search you and/or your luggage and goods. Cruise and airline operators reserve the right to deny boarding or to disembark any person in possession of illicit substances.
When passengers themselves make own arrangements for portions of their holiday in conjunction with arrangements made by Cruising Down Under Pty Ltd they should ensure the chosen means of transport is scheduled to adequately connect with these arrangements, and that we are made aware at the time of the reservation. We will not be held responsible for any unforeseen circumstances that necessitate any changes to your travel arrangements.
Passengers with disabilities or requiring assistance must advise us at the time of reservation. Most suppliers have certain facilities available for people with disabilities or who require assistance. Please ask for details of such facilities if you have any special needs.

3. Travel Documents, Visas & Health
With the exception of travel within Australian waters, each passenger must possess a passport with at least 6 months validity beyond the date of return. It is the passenger's responsibility to be familiar with visa requirements, taking responsibility for obtaining all entry, exit, re-entry, health and other documents required by laws, regulations, orders, demands or requirements of the countries visited or transited. Cruising Down Under Pty Ltd will assist with these requirements on request. Passengers traveling to USA require passports with bar codes. We cannot accept responsibility for failure to have correct travel information. Travel advice can be obtained from various sources, including local government, local consular offices and the Australian Department of Foreign Affairs and Trade website: http://www.smartraveller.gov.au. Passengers should also be familiar with health requirements and the DFAT website also has a section on Travel Health or passengers can seek advice from their doctor.
Passengers are advised to check all travel documentation thoroughly upon receipt and must advise any anomalies to Cruising Down Under Pty Ltd immediately.

4. Payment by Credit or Charge Card
The prices shown on the Cruising Down Under website are for payments by cash (Direct Deposits, Debit Cards and EFTPOS). Additional Credit Card Service Fees will be applied to the dollar amount paid by credit or charge card. Our scale of these fees will be: Visa and MasterCard 1.5%.
American Express and Diners Card are not accepted at this time.

5. Prices
Prices will be confirmed with confirmations of Booking Requests. It is important to note that components within these prices may change at any time up until departure eg taxes. The inclusions within the confirmed prices do not include some services such as airport transfers, and sightseeing tours unless stated. They also exclude personal expenditure such as insurance, laundry, telephone calls, emergency evacuation costs, drinks, excess baggage, passport, visa fees, gratuities, and travel costs in Australia to the point of international departure unless stated.

6. Price Validity
All prices quoted are in Australian dollars, based on foreign currency tariffs and taxes published as at the quote issue date. Due to the fluctuation of foreign currency rates, Cruising Down Under Pty Ltd reserves the right to increase fares accordingly. However, any fluctuations after final payment has been made will not be passed on unless instigated by the holiday operator. Prices are valid for travel as specified and are based on per person twin share unless otherwise stated.
Special offers are released frequently. They are, however, always subject to strict conditions and limitations and these conditions and pricing may change without notice.

7. Baggage
Please check baggage allowances applied by airlines, cruise companies and coach operators prior to travel. Baggage allowances vary from carrier to carrier.

8. Late Bookings
We are specialists in late bookings but a booking request made within 30 days of departure cannot be processed unless full payment is received by us at time of reservation confirmation, or we are holding a credit card guarantee.

9. Taxes and Levies
Legislation requires us to collect from you the taxes and levies controlled by the airline, cruise line, government or authority.
These costs are additional to prices listed in this brochure and may change without notice at any time up until departure. Full payment of your holiday does not exempt you from implementation of additional charges outside of our control. We will offer advice in this regard, but regret we do not control, nor will we be held responsible for any government’s taxes, levies & airport charges.
All Australian and foreign country departure taxes that are payable prior to departure will be shown
on your tickets. Some countries charge departure tax upon departure and some airports charge a small Airport Improvement fee which must be paid at that airport on departure. Cruise companies charge port and handling tax as well as government taxes and fees.

10. Deposits:
If booking within 14 days of departure, a credit card guarantee or full payment is required immediately.
Deposits are generally required within 7 days of written confirmation however operators reserve the right to amend this payment period dependant on how heavily booked the particular departure is or how soon it departs. Deposits may be required immediately upon confirmation.
Some holidays are based on special fares or may have special conditions requiring immediate full payment. If for any reason the deposit is not received by the due date the booking will auto cancel. A deposit holds services requested but does not guarantee prices. Booking details will be sent with confirmation.
Cruise lines have different deposit requirements which vary from set dollar amounts to percentages of the total fare. Details will be advised at time of confirmation.
Bookings made within 75 days of departure require an immediate credit card guarantee at time of booking confirmation.

11. Deposits for Groups
Deposit requirements vary from cruise line. As a general rule a deposit of $200 per person is payable within 14 days of confirmation of the space.

12. Balance of Payment
Balance of payment is dependant on the length of the cruise/holiday.
For South Pacific & S E Asian holidays balance of payment is due 60 days prior to departure.
For other international holidays the balance of payment is due 75 days prior to departure
For holidays in excess of 21 nights the balance of payment is due 90 days prior to departure.
If for any reason the balance of monies is not received by the due date, we reserve the right to treat the booking as cancelled and to apply the applicable cancellation fees and other charges as detailed by the participating cruise line.

13. Amendment and Re-issue Fees
A fee of $25 per amendment per booking may be payable for changes made after a booking has been confirmed and will apply once a deposit is paid. Once documents have been issued, the $25 amendment fee applies plus any re-issue charges applied by suppliers. Re-issue means altering an existing booking, not a transfer to another package wherein cancellation fees may apply. (please refer to the cancellation fees section).

14. Cancellation or transfer the ownership of a booking
It is policy not to discuss any details of a passenger booking with any party except the passenger or a nominated representative of the passenger.
If a passenger wishes to cancel a booking this request must be made in writing to Cruising Down Under Pty Ltd. Additional handling/service fees may be imposed by the operator to amend the booking.

Cancellation charges vary by cruise line & other operators.
As a general rule Cancellations by the passenger (including group departures & individual members of a group booking) incur the following charges:
Outside 90 days prior to departure loss of deposit
90-46 days prior to departure 25% of the cost
45-31 days prior to departure 50% of the cost
30-00 days prior to departure 100% of the cost

A reminder that all cancellations must be received in writing.
Reasonable professional service fees, plus any charge levied by suppliers, which can be up to 100% depending on each supplier’s rules will be applied.

15. Cancellations and changes by our suppliers
Extreme circumstance beyond our control may necessitate changing a booking, (eg: if a cruise line or airline changes their schedules). If the changes result in your holiday costing more or otherwise being materially different from that contemplated prior to the changes being effected, and we have already accepted your deposit or balance payment; you have the right to ask for a rearrangement or to withdraw from the holiday. We will apply a $35 per passenger amendment fee to cover our professional services plus any charges levied by suppliers. The balance of monies will be refunded less these amounts.

16. Refunds
Once the reservation we have booked for you commences, no refunds can be made for any unused services whether by choice or circumstance.

17. Passenger Names and pre-departure contact
Booking forms must be completed prior to any holiday documentation being issued. The information on these forms is totally confidential and correct spelling of names and passport details are extremely important. In many cases name changes after a booking has been made are not permitted. This may mean having to cancel the original booking and the resultant loss of the original cabin or flights plus any associated amendment or cancellation fees. Any request for name or initial changes after documents have been issued has the same risks and also attracts ticket re-issue charges.
It is essential to ensure that you advise us of a telephone number or address where you can
be reached if necessary within 24 hrs prior to your departure from Australia. All groups must provide a rooming list with above details at time of payment of final monies.

18. Airlines
Airlines involved in completing your holiday arrangements do not, by virtue of their endorsement of our advertising or promotions represent themselves as contracting with any purchaser of a Cruising Down Under Pty Ltd holiday. Airlines provide detailed travel conditions with their paper or e-tickets.

19. Air fare classes & ticketing deadlines.
Airlines, both domestic and international, have advised that they now conduct automatic matching of tickets issued against bookings made. We will base our costs and invoices on air fare classes as per the quote provided. In the event that the rules for the air fare booked has a ticketing deadline prior to the normal final payment date full payment of the airfare component of the holiday will be required. You will be advised by us to ensure the ticketing conditions are met.

20. Privacy Laws
The client acknowledges that he/she will provide us from time to time with information about the client of a personal nature (“Personal Information”). The client consents to us using any personal information for the purposes of making and completing airline bookings and travel related arrangements on behalf of the client. This information will not be shared with any other non holiday related third party.

21. Travel Insurance Essential
It is a condition of sale of our holidays that passengers are offered their choice of adequate travel insurance for their protection. It should be borne in mind that cruising holidays can be subject to diversions in extreme weather conditions or other circumstances, which can cause major disruption to schedules. Passengers electing not to take Travel Insurance accept responsibility for their own costs or losses sustained in the event the travel arrangements are disrupted and will be required to sign a Cruising Down Under Pty Ltd indemnity form.

22. Website Information
Product descriptions, maps and images of all our holidays are based on current information
provided by suppliers. Facilities are subject to change at any time and we do not guarantee
the standard, class, or fitness for purpose of that service. Maps are shown for general information
and may not reflect actual locations or services provided. Images show geographic areas, but are not necessarily included in the holiday. Cabin images are representative only; actual rooms occupied may vary in decor and inclusions.

23. 24hr Overseas “Helpline” – for use whilst overseas only
A 24 hour ‘Helpline' is provided by every travel insurance company.
Cruising Down Under Pty Ltd does not have a 24hr help line available.
Your holiday has been carefully planned, however, if in the course of your trip whilst you are overseas you do encounter a situation which is not to your satisfaction, we strongly recommend that you immediately contact the Purser in the ship’s reception area or the tour operator. They will promptly endeavor to rectify the situation to your satisfaction. If you are still dissatisfied please contact your travel insurance 24hr Overseas Helpline detailed in your travel documentation.

24. Goods and Services Tax (GST)
All Australian domestic (coastal) cruise holidays are subject to GST. This tax is included in your taxes and fees included in your final fare payment.

25. Travel Compensation Fund
Cruising Down Under Pty Ltd is a member of the Australian Travel Compensation Fund (TCF). TCF is a fund administered by a regulatory body established by government to give passengers financial protection in the event of a member’s failure. Cruising Down Under’s passengers can have complete confidence that the Company meets the strict financial criteria necessary for participation in the TCF.

26. Variation & Acceptance Terms & Conditions
These are the current terms & conditions and replace any other terms or conditions previously published.
Cruising Down Under Pty Ltd, act in good faith, but we live in fast moving and changing times and we give notice that terms and conditions may change within the validity period and for the most current up to date versions passengers should refer to our website at www.cruisingdownunder.com.au
